On March 27, 2020, the U.S. Congress approved emergency funding to assist local governments and community residents to respond to economic and other impacts of the Coronavirus pandemic, through the Coronavirus Aid, Relief, and Economic Security (CARES) Act.  The CARES Act included supplemental allocations of Community Development Block Grant (CDBG-CV) program funds for local governments, including the County of Bergen. These funds must be used to respond to the direct impacts of the Coronavirus pandemic. "CDBG-CV funds must be used to prevent, prepare and respond to coronavirus."

To fulfill the purposes of the CARES Act, the County of Bergen is inviting municipalities, county agencies, and nonprofit agencies to submit requests for CDBG-CV funds through this Request for Proposals (RFP).

A total of $5,562,321 in HUD grant funding is being made available to address the following County of Bergen CARES Act priorities for the following eligible activities: 

  • Acquisition
  • Public Facilities Improvements/Public Housing Modernization
  • Public Service - NEW
  • Public Service - Expanded Service (with documentation)
  • Fair Housing Activities

 Proposals addressing other activities or service types will not be eligible to receive funding under this RFP. 

Funding commitments and the execution of contracts are subject to the the County of Bergen’s receipt of grant funds from the U.S. Department of Housing & Urban Development (HUD).  

The following projects and costs are specifically not eligible under this RFP:

  • Supplanting of funds for existing programs or activities (substitution of CARES Act funding for other funding);
  • Improvements to government or public buildings
  • Applications from for-profit entities;
  • Anything that is listed as ineligible or unallowable in the applicable CDBG grant regulations.

HUD is expected to issue further guidance regarding use of CARES Act grant funds in the coming weeks.  HUD regulations governing the standard annual CDBG allocations of funds will be applicable to the CARES Act funds unless specifically referenced as an exception under the County’s grant agreement.

Project & Activity Qualifications  [hide this]

To qualify for CDBG-CV funding, proposed projects and activities must satisfy the following criteria:

  • Principally benefit very low, low or moderate income persons (as defined by American Fact Finder.gov)
  • Projects awarded federal CDBG-CV funds are required to ensure that all persons are served equitably and that a person is not denied services because of his or her race, color, religion, national origin, sex, familial status, or mental or physical ability. The State of New Jersey carries additional protections for persons experiencing discrimination based on a person's source of income, marital status, Age (if over the age of 18), sexual orientation and gender identity. Applicants must be prepared to establish, amend, or maintain program admissions, occupancy, and operating policies and procedures (including policies and procedures to protect individuals’ privacy and security), so that equal access is provided to individuals based on any of the above listed protected classes. This requirement includes tenant selection and admission preferences. Fair Housing is the right of all people to be free from discrimination in the rental, sale or financing of housing. Equal access to rental housing and homeownership opportunities, regardless of race, color, religion, national origin, sex, familial status (the presence of children under 18) or disability, is the cornerstone of federal Fair Housing Policy. 
  • Proposals must be submitted in ZoomGrants by the deadline specified above June 30, 2020. Late proposals will not be accepted or considered.

Eligible activities are as follows:

  • Acquisition
  • Public Facilities Improvements/Public Housing Modernization
  • Public Service - NEW
  • Public Service - Expanded Service (with documentation)
  • Fair Housing Activities

Only projects that meet the U.S. Department of Housing and Urban Development's criteria for CDBG funding will be awarded funds.

All proposals and programs awarded funding through this RFP must adhere to all applicable federal, state, and local laws and regulations including, but not limited to, the following:

Title VI of Civil Rights Act of 1964 (42 USC 2000d et seq.)

Title VIII of Civil Rights Act of 1968 (42 USC 3601 et seq.) Executive Orders 11063 and 11246, as amended by Executive Orders 11375 and 12086 and as supplemented by 41 CFR Part 60.

The Age Discrimination in Employment Act of 1967 (29 USC et seq).

The Age Discrimination Act of 1975 (42 USC 6101 et seq).

Section 504 of the Rehabilitation Act of 1973 (29 USC 794 et seq.) and 24 CFR Part 8. Prohibits recipients of Federal funds from excluding any qualified persons from participating or receiving benefit from, any federally funded program or activity based solely on his or her disability.

National Environmental Policy Act of 1969, as amended, 42 USC 4321 et seq. (“NEPA”) and the related authorities listed 24 CFR Part 58.

The Clean Air Act, as amended, (42 USC 7401 et seq.), the Clean Water Act of 1977, as amended (33 USC 1251 et seq.) and the related EPA regulations at 40 CFR Part 15, as amended from time to time, and Executive Order 11738.

In no event shall any amount of the assistance provided under this Contract be utilized with respect to a facility that has given rise to a conviction under the Clean Air Act or the Clean Water Act.

The Americans with Disabilities Act of 1990, as amended, (42 USC 12101 et seq.), the Architectural Barriers Act of 1968, as amended, (42 USC 4151 et seq.), and the Uniform Federal Accessibility Standards, 24 CFR Part 40, Appendix A.

Drug Free Workplace Act of 1988 (41 USC 701 et seq.) and 24 CFR part 23, Subpart F.

Davis-Bacon and related Acts. The Wage and Hour Division of the U.S. Department of Labor determines prevailing wage rates to be paid on federally funded or assisted construction projects may apply.

Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as Amended may apply.

Regulations at 24 CFR Part 87 related to lobbying, including the requirement that certifications and disclosures be obtained from all covered persons.

Executive Order 12549 and 24 CFR Part 5.105 (c) pertaining to restrictions on participation by ineligible, debarred or suspended persons or entities.

Executive Order 13559 and 24 CFR Part 5.109 pertaining to participation of faith-based organizations in HUD’s programs and activities.

Regulations at 24 CFR Part 882.708 (c) pertaining to site and neighborhood standards for new construction projects.

Regulations at 24 CFR Part 570 pertaining to Community Development Block Grants, as applicable.

Regulations at 24 CFR Part 5, regarding Income Eligibility, as applicable.

Federal Funding Accountability and Transparency Act of 2006 (“FFATA”) (Pub.L. 109- 282, as amended by Section 6205(a) of Pub.L. 110-252 and Section 3 of Pub.L. 113-101)

Federal Whistleblower Regulations, as contained in 10 U.S.C. 2409, 41 U.S.C. 4712, 10 U.S.C. 2324, 41 U.S.C. 4304 and 41 U.S.C. 4310.
